Re: Non payment for delivery crew

I am deeply gratified that this turned out for the best for you. I feel sorry for the lady and I hope she gets justice. What happened with your crew, especially the young Brit trying to get home? We were all rooting for her. I bet this is a lesson that she will always remember. All the best to you and yours.

Re: Non payment for delivery crew

What kind of attorney did you hire? Was it you or your attorney that filed the USCG lien? Do you think you could have reached the same or a better settlement without your attorney?

Re: Non payment for delivery crew

I hired a marine attorney who after hearing my story charged me minimal rates. For the lien I did it myself by following the guide lines on the CG Web site. The lady owner paid for our flights home. Got home in time for my daughters 11th birthday party.

Likewise I happy for the OP that it worked out.

This thread was enough to bring me out of "my CF" holiday. While this will be meaningless to the OP, it will make sense to a couple of the posters on it

Do you think it was the attorney, the USCG lien, or the combination that brought the settlement? Do you think hiring the attorney was the key factor in arriving at a settlement? What exactly did your attorney do for you? Write a letter to the owners? File a lawsuit?

I had to hire an attorney in Honolulu and I ended up filing a lien with the US Coast Guard. Long story short. I have now been paid and the lien has been removed. This ended up costing the owners considerably more than they owed me when I completed the contracted delivery.
This was all sorted out by the lady owner who turned out to be a very honorable Lady which is a lot more than I can say about the other party. Turns out she was conned out of a lot of money by this Guy. Obviously I cant put his name up here which is a real shame because this seems to be a pass time of his. Ripping Ladies off.
Lifeboatcox, very glad this was resolved for you.
Thanks for updating us.

Re: Non payment for delivery crew

I think it was the fact that they wanted to sell the boat. The lien made that very difficult. The attorney sent a letter to the guy but he just laughed at it. The deciding factor was the Lady owner.

Re: Non payment for delivery crew

Congrats.

Often a little well placed legal pressure is the most effective solution and it can usually be accomplished at nominal expense.

I don't want to over emphasize the positive result of the lien, but I hope your experience can serve as an example for CF readers. Recommended "expert" (read commercial) assistance is not always the "best" or least expensive method to resolve conflicts, or solve other nautical queries. There are myriad inexpensive "non-expert" (read non-commercial) solutions available to almost every situation. Key knowledge can be obtained from reading shared experiences like yours.

CF members, if you have first hand knowledge, share it. (Many CF members are not willing to share their knowledge and first hand experiences, and instead use the forum to exchange information privately to the detriment of the community).

Again, lifeboatcox, thank you for sharing.

P.S. What was the name of the boat?
