Perdock's wife is making some pretty serious allegations about Perdock lying on his written time-line preceding the 'accident,' starting with whether he actually made breakfast for his son as he claimed--and from there it just snowballs. (She says Perdock never made breakfast in his life. She made a special breakfast because it was the kid's birthday.)

She tells of a confrontation on the driveway about 6:00 pm when Perdock was leaving to take the boat out and she got pissed because the kids were still home on account of the birthday party and he was abandoning the kids to her which she felt was unfair. Perdock's written time-line has him driving the kids home at about 7:00 pm. Just a little bit different than her version. (Sarcasm.) One has to wonder what the kids and parents will testify about.

She pretty much says the entire document is a lie.

Well, I suspect this is digital. Either she's right; or he's right. And if it's the former, we have Perdock's written document constituting criminal obstruction of justice. Hello jail time Mr. Perdock. And hand in that badge on the way out.



There are five people who place Perdock at the bar before the accident, including one man who claims to have raced his boat against Perdock on the water (possibly on route to the bar).

For something entirely new:

'Donna Perdock makes one other interesting point. She says Russell Perdock uses eye glasses to drive at night or when his eyes are tired. Perdock has testified he was not wearing glasses at the time of the crash. Donna Perdock says Russell Perdock's night vision is so bad that she had to direct him around buoys at night, even though he was familiar with their location. She says, "Driving on a moonless night in the dark? That was my first inclination of the reason why he didn't see the sailboat." '

The longer this case goes on, the more evidence is flushed out for the defense.

Next thing you know, the DA will claim he is unable to prove a an obstruction of justice case (in addition to reckless driving cases). He can only prove manslaughter cases where the driver was drinking but not really driving and got hit from the stern while being the stand-on vessel.

I wonder how many rats will abandon this sinking ship? Then turn their words against those they were at one time protecting? It's quickly turning into every man for himself, and there will be lots of finger pointing. I can only imagine they will nearly all be pointing to Perdock, AND A VERY SMALL GROUP....HAHAHAHAHAHA....about time.....i2f

Jerry Brown's office has confirmed that he is looking into the case.

It appears that defense counsel has filed another motion to be argued June 30 to have the DA removed from the case. June 30 is the trial date.

"FYI to the Sheriff's Department, it was seen and noted by many residents that your department was, I believe the correct word is tailing, the reporter from ABC News in both marked and unmarked cars during his time up in Lakeport (it is a small town, you are recognizable with or without a badge). If you are telling the truth and having nothing to hide then why are you following around a reporter? "

That was an interesting comment to the article about the 911 tapes being rediscovered.

If the Sheriff's department really was tailing a news reporter, then you know they are into intimidation.

And then this follows:

"There are several people who were present the night of the accident but are fearful for their lives to testify that they saw what has been both confirmed by other witnesses and by professional investigators, that the sailboat had it's running lights and cabin lights on."

Makes you wonder how bad things really are out there.

At the June 30th hearing, it was reported that there were so many uniformed and plain clothes police in attendance that day that there was at least one cop for every protester. In addition, "someone" had organized a pro-Perdock group of demonstrators. The atmosphere that day was also described as "incredibly intimidating" by a person who was there. That they would resort to intimidating a reporter by tailing him is of a whole with their past actions.

Manslaughter Charge to be Dropped

But not the DUI. Go here:

As I have said before, and regardless of how one views the liability, prosecutorial and law enforcement misconduct is so transparently rapant in this case that both charges should be dropped.

Under federal and all state law that I know of, you cannot refile the manslaughter charge if the case is dismissed after jury selection has begun (July 7th) - double jeopardy. But in California, who knows?

Well Amen. Dinius's nightmare is coming to an end.

Let's hope it's just beginning for the good old boys in Lake County.

$64 question: Is Perdock going to be charged?

Bet not. Hope I'm wrong.

Dinius: AFTER the manslaughter charge has been dropped (which has not happened yet), please file an ethics complaint against every DA who was in charge of your case.

Does that create a conflict of interest so that a new DA must handle the DUI case?

Having been nearly killed by a DUI driver, I don't normally say this. But just this one time, I hope Dinius beats the DUI charge. Prove the sailboat wasn't moving or something, so he wasn't driving. Whatever. Would to see the DA get more egg on his face.

Even if Hopkins goes through with the DUI charge, can there be anyone in Lake County (which is to say, the jury pool) who doesn't already know the torture Dinius has had to endure these last couple of years. I doubt even Clarence Darrow could convince 12 people from that pool to agree Dinius deserves more abuse at the hands of the Lake County "system," and Hopkins will never be mistaken for Clarence Darrow.

Done deal. Manslaughter charges were, in fact, dismissed yesterday per the local media.


District Attorney, Jon Hopkins formally dismissed the manslaughter charge against Dinius on Tuesday.
"I moved to dismiss the charge in the interest of justice," Hopkins said. Remaining charges include: felony boating under the influence and two misdemeanor boating under the influence charges.

The problem is that the dropping of the first charge was a PR stunt to get the public to stop watching the case and wander off. The fact is that the second charge - BUI and causing great bodily harm - is essentially the same charge and carries prison time for a conviction, but it omits the media-attractive word "manslaughter."

I hope people aren't so easily fooled, because Bismarck Dinius is still in extreme jeopardy.

Lot's of people still upset, saying it's a sham dropping just the manslaughter. BUI felony that he's persuing due to Thornton's death is a three year term, versus the 4 year for manslaughter charges.
