To Clarify for everyone. My brother in law is not a dead beat father, his son now is 21 y, he owes $5700 for child support and $3500 on back taxes when he won on a slot machine in Las Vegas back in 2010. Which he lost it all back the same weekend.

Times are pretty tough here in Hawaii unless you own an ABC store. My brother in law is a porter for one of the hotels here in hawaii and recently loss his job of 17 years. He has an opportunity to crew with his friends a once in a lifetime round trip to the Philippines.

As all of you guys has commented I clearly see that it's not advisable for him to take this trip.

Would be like the days of old when guys with VD were supposed to be kept onboard when in port!

Major issues would be all the US territories along the route thru the pacific and also the destination. They would no doubt contact the US embassy and have him shipped back.

To the OP,

Purely out of curiosity, what's your BIL's reason for not paying child support? My brother stopped paying child support when his 16yo complained the mom was spending the money on a boyfriend instead of her & ran away to live with our sister. The 16yo is now 19yo, and has been living with him for the past 2 years, after spending a year with our sister to get away from her mom. The state is still hounding him for child support and won't renew his drivers license; something he's reluctant to pay since he fully funded the child whilst at his sisters, was never in arrears when she was with his ex, and now in his care. He doesn't see why he should fork over a lump sum to pay for an exes new Lexus. I can see his point.

That said, part of getting married and CHOOSING to have children in America is accepting that family court may become a very real part of your life, no matter how unfair. It's the potential hidden marriage tax. A tax that makes income, property, capital gains, and estate taxes seem frivolous in comparison.

My God... what is it with Hawaii and BIL's? I have the same exact issue!

He has not had a job in his adult life... I asked him why and his response was "no jobs". I guess that's an OK reason except there are 49 other states and a bunch of territories and I am sure there is a job out there if you are willing to move... upon which I was informed that this is not an option because the Hawaiians take their family connections so seriously. Of course, my response was... "if you take family so seriously then get a job and pay that child support".

With that said... he is a great stay-at-home dad while my sister works her butt off.

He owes child support AND back taxes -that is the poster child of dead beats. Sounds like his choice is to find a job or go sailing and we all know which is the better choice, don't we?....

Not really sure if that's true, owing tax on money that you won and subsequently lost before leaving a casino seems a bit harsh. Seems very different from owing income tax. Perhaps complicated by the fact that he is trying to make extremely high child support payments?

The child support issue is a complicated one too, he could owe a back amount because he is busy trying to keep up paying for the current fees(which, if he works harder and earns more will go up of course, leaving it almost impossible to pay the back amount). I watched a sad situation develop in the house of a girl I was dating... her mom got a divorce, cleaned up financially including large child support payments and retired. Bought a couple nice new matching cars too.

Even the kids found the situation unfair to the dad who still works like a dog and lives in a small bachelor apartment.
Not knowing the whole story makes it hard to pass judgement imo.


That being said, the captain would show very poor judgement having him along. Good person he could well be, big risk he certainly would be.

Mai-tai,

Your BIL has got himself crosswise legally speaking. As far as I know, the only way out for him will be to go back to court and petition for a change. They may or may not forgive the back child support. But with the problems he has, he'd probably even be turned back at the Canada border. I can't imagine forcible deportation from the Phillipines would be "nice."

In the meantime, it would ruin the reputation of the skipper. Once having brought an illegal into a country, the skipper's name would go on the "examine most closely", "search the most carefully," list. Not a good place if he wants to do more cruising. IMO, this would "harm" the skipper. Do no harm is a fairly simple concept; maybe your BIL should be introduced to it.

Internationally, Customs and Immigration Departments do communicate quite fully. Beware!

Typically, one must have 6 months remaining on a passport to enter a foreign country legally.

A US passport is valid until its listed expiration date. If you are a US citizen, you may even RETURN to the US with an expired passport (up to 1 year post expiration date). If flying or boarding a commercial ship, that rule is not honored at departure time; your return ticket must be issued/used no later than the expiration date. You will be fine if you don't push your luck, and over-extend your stay passed your passport's expiration date. Mauritz
