Re: Can a fireman force you to abandon your boat?

Isn't thread drift amazing. Kind of like free association and it sometimes leads to some very interesting discussions and information. Or sometimes turns an innocent discussion into a gun thread...

Re: Can a fireman force you to abandon your boat?

I don't disagree at all and hope I have not indicated in any of my posts animosity towards the CG.

Doesn't mean I would always agree with them or not consider making my own decision in a...

Re: Can a fireman force you to abandon your boat?

In the articles I've read it seems clear that the captain was being ordered off the boat or suffer the penalties and consequences. That was certainly the belief of the captain of the Satori. Here's...

Re: Can a fireman force you to abandon your boat?

Read the article. A quote "In a two-to-one decision, the appeals court upheld the lower court's ruling in part. It believed that the Coast Guardsmen at the scene had reason to believe Northern...

Re: Can a fireman force you to abandon your boat?

Thanks for elaborating more on this event. I had read both sides but mainly wanted to point out the potential for the USCG to order a captain to abandon ship. There are certainly two sides to this...

Re: Can a fireman force you to abandon your boat?

Not true according to US courts. As ruled by the federal district court and confirmed by the US First Circuit Court of Appeals in Boston the US Coast does have that authority. Read the article...

Re: Can a fireman force you to abandon your boat?

Not so with US vessels and the US Coast Guard. See my earlier post. The captain of a US fishing vessel was ordered to abandon ship by the USCG. The vessel then stayed afloat and finally required...

Re: Can a fireman force you to abandon your boat?

Your fault. You forgot to put a smiley face in the original post so all of us slow learners could figure out there was humor involved.

Re: Can a fireman force you to abandon your boat?

But, how much does your average firefighter (one does need to be PC in the terminology ) know about boats? Would they understand a boat might have diesel or gasoline on board, propane...

Re: Can a fireman force you to abandon your boat?

Perhaps just a better wording of the original comment. Offshore state and local will not have jurisdiction. Of course the USCG has authority over a US vessel offshore or inland.

Re: Can a fireman force you to abandon your boat?

I have wondered about the case of the Westsail Satori. In the movie The Perfect Storm the boat was called Mistral and the captain represented as an arrogant drunk who was unable to deal with the...

Re: Can a fireman force you to abandon your boat?

From my experience and research I think this is the correct answer. Offshore the USCG will have authority over any US boat. Otherwise you are dealing with state and local authorities and the laws...

Re: Can a fireman force you to abandon your boat?

According to a court case the USCG has the right to both.

U.S. court says Coast Guard has the right to order master to abandon sinking ship - Professional Mariner - February 2007...

Re: Can a fireman force you to abandon your boat?

In the perfect storm the captain of the Westsail 32 Satori was ordered off the boat by the USCG after the crew (according to the owner without his permission) radioed a Mayday. He said he decided...
