There are eight criteria for when you need a permit, for sailboat races the first one is the most important... It requires a permit for any event "on or near navigable waters." This isn't rocket...

I have raced just about everywhere on the eastern seaboard, the Gulf of Mexico, and california. I can only think of two or three racers who would meet your description.

However last regatta I ran...

So a boat under sail is tacking upwind inside a channel... The vessel under sail has also rolled up her jib to increase her maneuverability...

And it is the overtaking vessel that is complaining...
