Frankly you are all wrong, the offense is Boating under the Influence - a BUI. The operator of the vessel will be charged with a BUI if they are under the influence. Other people on the vessel will not be changed with anything. It is treated like a DUI other then you do not lose your license to drive a car but in some cases you could lose your vessel as the authorities do have an option to cease the vessel.

People who are under the influence and fall overboard, drown, because they are disoriented and swim to the bottom. Not a great way to go.

Good point, but one could argue that a good salesman will seal the deal, where as a poor one will let it slip.

Your question to LE's is self fulfilling as most people are motivated to excel in their careers by being successful and consistent..... Yet admitting that to you, somehow is an admission of guilt.


No doubt, there are those who brisk at authority figures and challenge their motivation, but is that factual or just personal opinion?

Too true Rich......If I think back to my youthful days when I drank way too much at anchor and really would have been useless in an emergency.... I shudder!

Now...is it wisdom or fear of Big Brother that stops me.

I dont think the cops mentioned in the op meant they would arrest for one drink. Here in washington state there have been a number of high profile bui fatalities including at least one drowned operator that fell from an anchored boat. You are required to maintain a watch on an anchored boat so if you are on watch you need to be sober. Period.

I have read that in canadian waters you may not have an open container unless moored,or at anchor in a vesel with a working head and adequate births for all aboard. If true I have violated that one in rubber boats in whitewater more than once.

And yet no one regales us with the personal tale of cuffed and stuffed onto the water cops boat for having a toddy on the hook.

No shortage of doomsayers or proper path preachers or folks likely to throw empties at jet skiers. But no validation of the original topic beyond the "Well da police said"

Get real. If you want nothing more than mint tea in a remote anchorage its your choice.

I like a nice taste of wine from a glass with my evening meal

I like having a well stocked bar. More for hospitalities sake than immoralities these days.

Agreed!.....I honestly do not know of anyone who has had a BUI at anchor.... Where is this overwhelming evidence of evangelical policing?

keep up the fear....helping keep the traffic off the water...

Anyone ever been to Columbus Day regatta in Miami? You can't find a sober person on 90% of the anchored boats. Law enforcement is everywhere, you pull your anchor and you will be stopped.

Go to any sand bar in Florida and anchored boats everywhere with much drinking. Never have I even heard of in instance of someone being harassed until you start your engine and pull your anchor. Then you are fair game and should be.

Living near Clearwater Beach Florida, we would get boarded every year and attempted boarding more often than that by coast guard. Why so often 10 years ago we had one of the only Catamarans around. They wanted to see the boat, never bothered us until we pulled anchor.

I feel perfectly comfortable in Florida having drinks at anchor, and am sure there are times I would be over leagal limits.

You know if people were just held accountable for their actions then none of this DUI/BUI or any other UI would be necessary as there are many other laws on the books that could be used. If you operate, control or otherwise are responsible for anything that could cause death, injury, etc. under the influence of anything then you should be held accountable. Just imagine how many people would drink and drive, boat and drive if they knew that when the shtf they were going to prison for a long time.
