For future reference to anybody interested
In the interests of trying to recoup some of my losses, I can send copies of oil and transmission fluid tests. A copy of the full survey is also available

I've heard previously that people resell surveys and similar - possibly through a trustworthy broker?
Figured i'd offer it up myself, as I won't be hearing back from Massey Yacht Sales on this one

The boat is still grossly misrepresented as per the verbage of the current YachtWorld listing.
Gently sailed? Well maintained? Out on the hard? When this thing comes out the water next, it'll be evident just how many bashes it's had
Nothing gentle about any of it!
Caribbean survey recommended bottom paint in 2014/15....this thing hasn't seen a brush since before then

Dave, It might be -- in Germany -- it sure as heck isn't in the States or Australia.

Your "due diligence" must be diligent, indeed.

Maybe someone from Germany who knows for sure can answer this question.

I feel for the OP as I've witnessed this misery on many occasions.
The only protection is education. I offer Marine Survey 101 as a guide on how to inspect a boat before taking your hard earned money out of your pocket to hire someone like me.

What a nasty story, thanks for sharing!
Was in Florida last week looking at boats near a buddy in Sarasota. Saw a couple nice ones and a couple filthy rags. Had seen this one in my search screen and considered a ride down to look. Will stay away from that broker too - they still have the same ad up.....
Noticed a vast difference between brokers. Some were very responsive and some couldn't care less. Weird!

Really glad I saved you a drive! There's a Cyclades for sale in Antigua with full disclosure and the offer of a surveyor report detailing the damage on that boat.
It's basically the polar opposite of this one where you have to travel to the very end of the USA and fork out $1500+ to find out it's an overpriced disaster.

If anyone is interested in pursuing...another heads up.
Make sure you get there in advance of the broker - before they get chance to air out the all the rooms. That way you'll get to smell just how the plumbing is struggling on there too

Take your time. The world is full of boats people are trying to sell. There is absolutely no urgency for the buyer.

Not really. I think if you find the boat that fits the bill at the right price you should jump at it. Having said that, it is assumed you know what your look for and you have spent a great deal of time traveling all over and searching. Yes lots of boats for sale but most are not what your looking for.

Not the attitude to have in what's quite clearly a buyer's market.

I guess it depends on what class of yacht we are talking about here, but 40 foot mass mkt toys are certainly not hard to find.

No they are not, however I believe the point is, when you find one clearly better than others of its age, and priced lower than average. Make an offer.
I got mine at considerably below average asking price, and it was in much better than average condition, so much so I was real suspicious that it had to have some kind of serious problem, but neither I nor the surveyor could find it, and it hasn't appeared in three years.

Boats priced or sell, sell and do so sometimes quite quickly

Fair enough. But I don't think my generic advice to someone looking for a used sailboat would be 'if you see one you like, get all excited and anxious someone else will buy it.'

This thread died out some time back. But I used it's lessons to start my search for a boat. Found another boat advertised inaccurately to suck one in.
"This Catalina 42 is ready to go cruising the world." with a 17 year old rig......real ready!

Marigot Rose isn't listed any more either, so I think someone bought the lemon :s

Lesson here is to Google a boat for its history, see threads like this and heed the warning.
Unless they paid $40k for it and like a project...they've been duped
