This is all a tempest in a teapot. Of course state and local officials have authority. Someone loses a battle with a local or state authority over anchoring or sewage discharge rules or whatever and in righteous indignation then gins up a less than half-baked legal or constitutional theory. If you have the resources or the support of the Heritage Foundation or whatever, try your case in court. Otherwise - just no.
