Probably, but it is difficult to secure jurisdiction over the owner if he/she has sailed away on another vessel. If, as has been implied, there was insurance that provided coverage AND was in effect, the entire thing is more difficult to understand. Of course, the marina might have protected itself in several ways, but it is not always easy or inexpensive to do so using acceptable methods.
