How so?? The windsurfer was the stand-on vessel based on that perspective and the limited knowledge we have of the situation

But also split blame because of an obvious complete lack of watch keeping by both parties. The sail boarder was intent on not falling down, and sailors were... inattentive to say the least. Notice how slowly the heads appear. Didn't see him at all. They seem only dimly aware that they have hit anything.

Actually they do in a negative way. 17 (b) requires you to NOT do that.



But if you don't follow Rule 5, then Rule 12 almost becomes moot. This is not a situation where the windsurfer is standing on, he's clearly totally unaware of the other boat.



As Adelie says both are at fault. I agree that the sailboat bears the brunt of the fault, but I'd say the windsurfer carries quite a bit more than 5%.

I don't know of any other way to windsurf a watercraft but to simply stand-on it.

Classic case of both crafts not keeping watch of what lies behind the sails.

A friend was taking a ride on a narrow gauge steam train when he saw a rider on a dirt bike on a trail that ran next to the track. Up ahead the track crossed the railroad line and the dirt bike rider was so focused on riding his bike as fast as he could that he didnt notice there was a train on the tracks.


He crossed the track at the moment the locomotive passed the intersection and ended up bouncing his bike off the large traction tires of the locomotive which is the only reason he didnt go underneath the locomotive. I dont think he had any serious injuries, but that was one very lucky kid. A couple of yards either side of his impact point and he would have been mincemeat.
