I would file a police report and report it to my insurance company but not file a claim. Then do as Calif. Ted suggests. I would tell him in writing he was at fault. If the guy sues or makes a claim in small claims court I would not even bother to get an attorney and probably at that point negotiate a settlement less than $1500. If it is in small claims court and you have the time you can easily argue the case yourself.

If you end up paying the other guy something, sometimes when you lose the battle, you end up winning the war!

Regardless of fault, how much is your time worth? $1,500 in exchange for a release of liability, and move on with your life while Karma evens things up? I'm not saying it's the right answer, but scumbags will do their best to drag you down to their level and beat you with experience. Some things are worth fighting, but nobody can decide what those things are for another man.

You're probably right. Discretion is the better part of valor, in some cases.

Just to put a bow on this thread, I told the owner of the Catalina that I would prefer to use insurance rather than settling outside.

The insurance company assigned 50% fault to each of us and is paying half the total claim for each respective party.

I think this is a fair outcome and appreciate all the support from the group.
