Florida boat taxes

Hi Guys,

Just would like to check if anyone knows how the tax works in Florida.
I bought a boat in Fort Lauderdale and transferred the registration in Delaware for tax purposes.

The boat are in Delaware for the last 8 months.
I am planning to go back to Florida, can I stay there for 1 year
without tax repercussions?

You will just need to register it. But since you have owned it out of state more than 6 months you wouldnt have to pay florida sales tax on it.

Where do you reside?
I hazily recall something about intention of having the boat outside FL...in the eyes of FL tax people.

To avoid Florida use tax you have to own AND USE the boat outside of Florida for more than 6 months. Florida is well familiar with the tax dodge of moving it outside the state and just letting it sit for 6+ months, in order to avoid the tax. You may be required to provide evidence (gas receipts, pumpout receipts, etc.) that would prove that you were using the boat, and not just letting it sit, during that period.

I also think that when you register in Florida, they are going to want proof that sales taxes were paid in the previous registered state. And if paid at a lesser amount than would have been levied by Florida, you are going to owe the difference at the time of Florida registration.

Tax free stay in FL for out of state boats is 90 days. Not one year. As a FL resident they may not consider it out of state.

Regardless you need to ask the State and/or an attorney. Not here. That can prove an expensive mistake.

It's very clear.

You get 90 days inside Florida as a non resident.
UNLESS you register the boat using the sojurners registration at the Florida DMV.

Taxes are not due with the sojurners. However it's temporary and not a forever thing. Best not to be a Florida resident trying to dodge taxes however. You'd better really be someone who is just visiting
