Seawater Filter for Motor Cooling

My boat has a seawater/freshwater cooling. The seawater runs trough a filter before it gets to the heat exchanger. On a boat I had before that filter was below the waterline but on this one here the filter is about 12 inches above the waterline. is that a common position for the filter ? I would have thought the filter should be below the waterline so the pump doesn't run dry on starting the engine .
