Thanks.
My vessel is Australian Registered and i also pay an annual QLD registration.

As for suppling you with the “chapter and section of the legislation”, well the very fact that i pay it should be enough but here you go >>> Part 3 >>> 60 Application of Act, pt 5, div 2 (Division 4 Registration of ships).....

Thanks.. but the very fact that YOU pay should be enough would only suffice if I was a sheep. But I conceed the point and thanks for the legislation link. That's exactly what I was looking for. I was only previously aware of the following.

Queensland
Transport Operations (Marine
Safety) Act 1994
Reprinted as in force on 30 January 2012

12 Relationship with Commonwealth Navigation Act
generally
(1) This Act does not apply to a ship to the extent that the
Commonwealth Navigation Act applies to the ship.
[s 13]
Transport Operations (Marine Safety) Act 1994
Part 1 Preliminary
Reprint 7C effective 30 January 2012 Page 19
(2) However, if the Commonwealth Navigation Act provides that
it does not apply to a matter if a State Act deals with the
matter and this Act makes provision for the matter, this Act
applies to the ship to the extent of the provision made for the
matter.

Apologies it was badly worded, i should have said "if you knew me and my aversion to giving govco more money than i should, then the very fact that i pay it should be enough".......

Thanks. Am I correct in thinking then that a registered ship ' that is in current commonwealth survey' would be exempt? They seem to have added that section?

Not totally sure if the below excerpt is the one you are referring to ? but if it is, this only applies to vessels that must be registered under the Shipping Registration Act 1981 (Commonwealth)

Quote:
(2) However, part 5, division 2 of the Act does not apply to the
following ships—

(a) a ship that must be, and is, registered under the Shipping
Registration Act 1981 (Cwlth), and for which there is a
current certificate of survey under the law of the
Commonwealth;

For more clarification see sections 12 13 and 68 in the Shipping Registration Act 1981
