Is a Jones Act Waiver needed in the USVI?

Hi there,
We are in the process of starting our charter company in the USVIs and I wanted to understand if the Jones Act waiver was in fact required or not. I understood the whole USVI to be exempt from the JA. We wanted to do crewed (not bareboat) charters on a new Lagoon and therefore would not be able to get a JA waiver for 3 years if it is actually required.

SEC. 21. COASTWISE LAWS EXTENDED TO ISLAND
TERRITORIES AND POSSESSIONS (46 App. U.S.C. 877) states the following:

And provided further, That the coastwise laws of the United States shall not extend to the Virgin Islands of the United States until the President of the United States shall, by proclamation, declare that such coastwise laws shall extend to the Virgin Islands and fix a date for the going into effect of same.

So it's all up to the White House
