Petition to liberate Leonel Carvalho (67)

Hi all,
I would like to ask for your support concerning the petition to the President of the Portuguese Republic, Dr. Marcelo Rebelo de Sousa, to help liberate Leonel Carvalho.
Unfortunately the official TV-news broadcast of 09. March 2018 concerning the case is in Portuguese, as is the Petition.
Roughly this is what happened: Leonel Carvalho is delivery-skipper. In 2014 he delivered a sailing-yacht from Brazil to Portugal for a Spanish owner. For some reason the Brazilian Authorities informed the Portuguese Authorities that the vessel is transporting 70 KG of cocaine. The Portuguese Authorities caught the vessel still outside Portuguese waters, searched the vessel, found nothing and accompanied him in convoy to Lisboa/Portugal for further investigation. The ship was searched meticulously 4 more times. Finally, with a swab-test, they found a tiny trace of the substance in the bow area that was made accessible by crowbar, which indicated the ship had been used for transport at an earlier time.
Leonel was declared innocent, set free, the Brazilian Authorities informed and the case closed.
Not so in Brazil where they issued an international search-warrant for Leonel Carvalho via Interpol. Neither Leonel, nor his family, nor the Portuguese Authorities knew any of this.
In 2017, delivering a ship to Greece, he put into the southern Spanish port of Cartagena for the night. 30 minutes lates he was arrested and transported to the high-security-prison in Madrid.
Now - 9 months later - he is still there and will be extradited to Brazil within the next days for "trial". Leonel Carvalho is Portuguese Citizen.
Today it's him, tomorrow it could be any one of us.

You're asking us to take on faith your claim that he is innocent of whatever charges the Brazilians have levied against him. And what is he charged with by Brazil?

Out of curiosity, what good is a petition to the Portuguese president going to do when he's held in Spain?

Suijin, I'm no judge, no solicitor nor a lawyer, so incapable to explain any of this. Maybe it helps if you could read the complete text of the petition in english?

Exmo. President of the Republic Dr. Marcelo Rebelo de Sousa,

We appeal to you so that together with the Exmo. Minister of Foreign Affairs Dr. Augusto Santos Silva, Exma. Minister of Justice Dr. Francisca Van Dunem and Exma. Attorney General Joana Marques Vidal, as in other cases, take extraordinary measures and at the highest level so that through cooperation between countries they can resolve this situation that has long since become unsustainable and incomprehensible. We have always believed that a person is innocent until he is found guilty, but we never thought it possible for a person to be found guilty having already been held innocent!

Although all the offices of the abovementioned people were contacted directly the response was, as always, a "push" of responsibilities between them that it was impossible to find resolution. This is why we believe that with joint action among all ministries it will be possible to find a resolution for a case that has been going on for almost a year and which seems to have no end in sight along the road.

Below we explain the situation with all the framework that we can give about it, not violating, even without wanting, any protection of the investigation that took place.

In the summer of 2014, Leonel do Nascimento Carvalho is contacted to transport a sailboat from Brazil to Portugal. He did not know the people so he questioned how they had gotten his contact. It was perceived that it was because he was known in the nautical environment for transporting several sailboats from Portugal to Brazil and for this reason he had been indicated as the person indicated for this transatlantic transport that, due to its difficulty, is not for inexperienced sailors
It was for this purpose that he went to Brazil (by airplane) and returned to Lisbon sailing with the said sailboat. About 2 days away from Lisbon was intercepted by Portuguese and Spanish authorities and informed that they would search because the boat was suspected of transporting drugs to Europe. Several tests were carried out to find the drug:
1) Still on the high seas, on 31 July 2014, however "for security reasons due to the meteorological conditions that were felt was interrupted (the search) having the sailboat been accompanied ... to the Naval Base of Lisbon".
2) At the Naval Base in Lisbon, on August 2, 2014, "the search warrant was fully complied with and all the compartments of the sailboat were traversed by PJ without any illicit being found. technical means on the inside and outside of the vessel and a diver has also been used to check the hull and keel of the vessel without any unlawful action being taken. "
3) In the dry dock, on August 8, 2014, "a new search for the parts that had been submerged with the use of even a scanner without any other narcotic product being found".
4) On September 4, 2014, "during the investigation of the PJ ... a new search was authorized for the vessel" and a collection of possible residues of narcotic product inside the sailboat was carried out. .) with a cotton swab dipped in methanol smeared a suspicious trait ... identified as a laboratory of cocaine. " However, and because we are talking about mere traces, this document continues as follows: "In view of the foregoing, it is necessary to conclude that despite the efforts made, it has not been possible to obtain enough evidence that, in the least, we can identify who, when and where they have introduced or removed from the ship the narcotic whose traces were collected by means of scrubbing and identified as being of cocaine, let alone knowing what quantity it was in. Mere residues of narcotic for consumption or tens of kilograms destined for trafficking.
The above phrases have been taken from the filing of the case at the DIAP in Lisbon (we have several documents from Portuguese authorities, in this case the Judicial Police and the Attorney General's Office, which prove what we say but, for obvious reasons, we can not make them available in full) that ends with the following sentence: "In these terms (...) I determine from now on the archiving of the records".

For a common citizen who has never had problems with the police or justice, the prospect is that it would have been filed in Portugal, Spain and Brazil, as it was supposed to be a joint operation between all. Unfortunately not ... On 04 May 2017, in the midst of a transport from a sailboat from Portugal to Greece, Leonel do Nascimento Carvalho is being held in Cartagena, Spain.

He has since been detained in custody at the Madrid V Prison Center under an extradition proceeding resulting from an international detention order ordered by the 5th Federal Court of Santos in Brazil, issued on September 30, 2015. In this establishment Leonel is treated as if he were in a third world country, where he would never have imagined 67 years old to see his life turned so unjustly and deprived of the one thing he has always done: to live in dignity and in a suitable way.

Until 04 May 2017 Leonel do Nascimento Carvalho was never informed that there was an international arrest warrant in his name. This international detention order was in the Interpol system, an organization of which the Portuguese Judicial Police is part. How is it possible that the PJ never looked for him in his fixed residence on Portuguese soil? How is it possible that a communication never came to Leonel saying that there was an international extradition mandate? This is for us the first great mistake of the Portuguese authorities.

Already during the extradition process (which is taking place in Spain), the Portuguese authorities were asked to state their views on whether they wanted to give protection to their citizen Leonel do Nascimento Carvalho. In response, the Ministry of Justice communicated that "Portugal will not exercise the right to issue the EAW (European Arrest Warrant), since in the current investigation no facts were found that allow the imputation of crime to the citizen Leonel do Nascimento Carvalho . ".

In fact, as mentioned earlier, the citizen Leonel do Nascimento Carvalho, in the context of the investigation carried out in Portugal under the supervision of the DIAP in Lisbon, was investigated exactly for the same facts that are the assumptions of the international detention order issued by the Federal Court of Santos and, in the face of these same facts, the Portuguese Public Ministry ordered the dismissal of the records. In this context, the position given by the Ministry of Justice and the Ministry of Foreign Affairs to the Spanish judicial authorities is acceptable. However here they could have decided to go further and decide to give protection to their citizen. They chose not to. We understand! Leonel do Nascimento Carvalho is a mere citizen of 67 years who has never had any problem with the authorities and is irrelevant to the Portuguese justice, whose fact that his name is not sound in the Portuguese society, does not imply a careful and meticulous action of the authorities.

And this response made it possible for the extradition process to continue to be tried in Spain and despite the fact that the record of the filing order issued by the DIAP in Lisbon is in the file with Spain, nevertheless, the Spanish National Court decreed in 22 of December 2017 the origin of the request for extradition to Brazil from Leonel do Nascimento Carvalho awaiting only a set of guarantees from the Brazilian government to proceed with it. Can we believe that we have reached this point? As a family, we thought it impossible for a citizen considered innocent to be tried again. Today we realize that justice is discretionary and that anyone can be the object of injustice, just because the authorities thus ignore what is in sight of all.

However we managed to gain some time after this decision by putting a new feature. A few days later we learned that this appeal was also dismissed, having started the 30-day count, which ends on 13 March.

The petition to the Spanish Constitutional Court, addressed by the lawyer in Spain, has therefore been left to us, the purpose of which is to prevent, even temporarily, extradition to Brazil. However the review of this feature can take months to be appreciated ... MONTHS! For those who are already unjustly detained at 10 months the prospect of waiting months for a decision seems like an eternity. For those who are 67 years old and seem like the rest of their lives ... Every day that passes seems months of life that are lost.

Thus, Leonel do Nascimento Carvalho is on the verge of being extradited for crimes investigated in Portugal for which it was considered that there were no indications that allowed his imputation. Worse, Leonel do Nascimento Carvalho is only extradited because he is innocent. If it were guilty the Portuguese authorities would exercise the right to issue the European Arrest Warrant, which would prevent extradition to Brazil!

A Portuguese citizen, with a long life course, without any blemish, is reportedly innocent after exhaustive investigation carried out by the Portuguese authorities, at a stage of life (67 years) when time is short, after being innocently detained for more than 9 months ( where he has since lost the birth of a granddaughter, his birthday with the family, birthdays of his children, Christmas, ...), is about to see the torment that is currently being increased by extradition to a country and to a prison system that deserves all the reservations and where we are all sure of its tragic destiny. To do this, simply search the internet and discover several pages. In the Related Links area we leave some but others will find for sure.

To all who read this Petition,
Leonel's family and friends ask you, with their hearts in their hands, to help us prevent this extradition by asking the Portuguese authorities that, using all the resources at their disposal, do not let the "absurdity" take vengeance and let the idea come true. better to be "guilty" than to be "innocent".

Doesn't really answer anything. In all likelihood the authorities in Brazil learned that the boat might be transporting narcotics and notified the Portuguese authorities. It's also reasonable to assume that the Brazilian authorities have more information regarding the boat, it's owners, and the involvement of Mr. Carvalho and so are continuing to pursue him as a result. In short, just because the boat was not found carrying narcotics when it arrived in Portugal does not mean that a crime was not committed.

I think passing around these sort of petitions with scant knowledge of the facts, like so many chain letters, is largely fruitless and to a degree attempts to subvert the legal process.

Well, this is the very strange thing they are saying in this Portuguese TV broadcast: Brazil is charging him for exactly the same crime he was investigated about and found innocent, same dates, same boat.

There's a huge difference between "found insufficient physical evidence of drugs on board to prosecute" and "dismissed all charges".

Hi Boatman61, still up the road in Fig da Foz ?

He's usually sailing singlehanded and did so on this trip.

I've been watching the TV documentary from the 9th maybe 8 times by now and am still not able to get it all. OK, my Portuguese is not brilliant and my Brazilian neither. In between they show documents and mark passages in yellow, reading them out loud at the same time, quite fast of course. So, I kept stopping it to read the documents myself, keeping in mind that this is only a fraction as the whole paperwork apparently has reached more than 16.000 pages.
It turns out that the owner of the boat first disappeared but now is in prison for drug trafficking and being part of a criminal organization. Before handing over the boat - so these documents - the owner himself did a trip to somewhere else and came back, the boat was under observation for a long time, re-named an registered in Portugal by the owner.
Reading these documents it looks to me like the Brazilian Authorities are doing whatever they can to twist the truth and just want to make Leonel part of this criminal organization, whatever the cost. As proof they use the fact that he first went up the coast a bit before turning Northeast, that it took him 42 days to reach Portugal - which is far too long in their opinion without giving any evidence concerning weather and currents - that he contacted the owner when he had a tear in the mainsail, and that he contacted him again to let him know his approximate arrival time. The calls and what was said is shown in the documentary, most of the time they couldn't even hear each other. Brazil claims this as proof that they knew each other for a long time and were business partners. But, according to eye-witnesses in Brazil and Portugal, they were treating each other exactly like one would who's never met before and doing a boat-delivery.
Also, it was found that the Brazilian Authorities didn't inform Portugal about having issued the international search-warrant via Interpol. It makes sense insofar as Portugal wouldn't deliver him for trial in this case.
In the documentary they interviewed friends and clients of Leonel who had boats delivered by him. He always used to contact them regularly, either by sat-phone or textmessage to let them know how their boat is doing an how it's going.
Also, the documents they showed, if on purpose from the Brazilian side to cause confusion or by accident, there is quite some confusion going on. In one document they pretend he is Brazilian, in another Venezuelan, another Colombian and another even American, just as if they didn't know in advance which country might arrest him and to have all options open to get him extraditet at all costs.

Now, not that anyone might misunderstand this. I've never met Leonel and don't know him. But: he's the best Friend of my neighbor (right now in the boatyard) for more than 40 years, and my neighbor is a very good mate of mine for many years. I know I can trust him with his judgement and everything else. Victor asked me for help, and if he asks he merits it. And actually, from the evidence I'm starting to grasp bit by bit it doesn't seem right for me what's happening there.

And yes, I'm sorry to say that, but fortunately I'm not a computer but a human being and things do go through your mind. Finding something like this on a boat one delivers is an absolute nightmare. Before I read that the owner did a return-trip to somewhere before handing the boat over I was wondering if, maybe, Leonel wanted to make sure the boat is clean, searched everything, found the 70 KG and chucked them over board to get rid of them. In the end, when I saw how they had butchered the boat to get to the space where they found the tiny remains of the substance I was starting to doubt this theory. There were no visible screws or fixations to take the whole bulkhead off to get to the space in the bow area. Assuming he expected something hidden there, how could he get there with hardly any tools and put it back in place looking like it was built like this?

those things are a lead pipe cinch to acquire, charges arent necessary. If you can get an EAW (a chargeless European Arrest Warrant) you can get Interpol to put out an International Arrest Warrant

Assanges predicament was in place because the prosecutor in Sweden wanted to question him having hours before let him go. So she filed an EAW. She could of course have questioned him in London, but refused. After 5-6 years she was forced to go to London by Swedens Supreme Court, it was over in a matter of hours, 'allegations' dropped.

European Law and their mickey mouse arrest warrants aren't worth a cracker, Interpol even more so

Being myself a portuguese citizen and (importantly) having lived 4 years in Brasil where I had to work with some authorities, lawyers, jails, etc, including having witnessed quite a lot of international drug trafficking attempt cases... I do feel for him.

IF it all comes down as told in the news and the reports confirm it, it will probably bounce back and end in nothing...BUT...in the meantime he´s in for quite a long time behind bars if he gets deported, even before the Brazilian justice actually start working on the case. What a nightmare.

There was a notorious case here in Czech Republic to which the media paid a lot of attention, where the girlfriend of a drug dealer was caught in the airport (with him, who carried a few kgs in his bag). He was honest about it, admitted the attempt and said the girl had no involvement or knowledge whatsoever... allegations that were supported by the investigation prior and after the case.
She still spent one year in prison awaiting the final decision.

Poor fella

It's easy to get caught in a bad situation even when you're careful. I knew a few people who went to various places for get togethers with a bunch of friends. There were a couple of idiots who brought drugs with them and got several people in hot water. Luckily for the acquaintances it was all sorted out but for a few days they were pretty nervous. If you're driving your car and get stopped, if a passenger drops a bag under the seat, you're more likely to get in trouble than the passenger.
