Amel Super Maramu 1997
We bought Jonathan in 1999 as a used boat from the first owner (because his
wife became seasick just when leaving the Harbor). Due to a broken shoulder we
started sailing her in 2000 mostly in the Gulf du Lion, Spain, France and Italy.
In 2002 we left the Med, crossed the Atlantic with an average speed of more than
8 Kt using only 12 Gal of diesel for the generator. We than sailed the Caribbean,
US-Eastcoast, the Chesapeake Bay and up to New Brunswick. Early 2007 we
passed the Panama Canal and sailed in 41 days to Hilo, Hawaii. British Columbia,
Cabo San Lucas, again Hawaii, Kodiak, Pan Handle, British Columbia and now
California where the next trips.
We did all the longer trips, only my wife and I because the Super Maramu is the
perfect fit for the shorthanded crew.

I spent a long time looking at the new Amel 54 recently and was very impressed and thought that it would be an ideal round-the-world boat for me. While I'm happy enough with my present boat, I do have a friend who might be interested - but I am not sure if the V.A.T. paid portion will work, both for the amount of time that the vessel has been outside of the EU and, if I recall correctly, VAT is lost if the sale is consummated while the vessel is outside of the EU (at least I know that is the case with UK registry). I assume that you haven't hired a broker (yes), is that correct?

I am not sure how it is with the VAT. As I know in Germany it depends on the Port of Call and the "Finanzamt" there where you enter. Cuxhaven e.g., the home of my TO yachtclub, let you reenter without charging you a new VAT.
Years ago I heard about entering the EU via the Isle of Man where tax exemption apply.
We had a broker in SF Bay but the brokerage expired. If I order a broker again it would be only if I can sell also without any limitations and fees. So actually we have a better margin for negotiations.

I just checked and if the boat has been out of the EU for more than 3 years it needs to be VAT taxed upon re-entry, I got that information from a colleague here who got that information from the Finanzamt. I'm not sure who Cuxhaven does it, but that might work for a German purchaser. The EU exception exists only for ex-pats returning to the EU from living overseas who can show that they have owned the boat for a period and have it as part of their 'possessions' upon return. I have that in writing from the UK, but it only applies to those who have not resided in the EU for several years.

One minor comment on your English version of the page, you say "She is specially designed for save and comfortable passage making". That should be "for safe and comfortable passage making."
Otherwise, the website looks great. I only wish I could afford to buy it from you!

VAT
Once VAT has been paid on a vessel, it will remain with the vessel forever.
The important part is to have proof of this, but this should be easy to find in boat papers / original invoice.
VAT does not expire ! I sold a 55' Jongert that was 25 years old, had been in the US for 15 or so years, we had to dig in archives all over the place in Holland but we found the document that showed VAT. The new owner then brought his yacht back to Europe without any questions asked.

As I know the rule to pay VAT again after a couple of years gives the tax officer a margin to decide depending on a certain case. But probably that applies only to the owner that "exported" the vessel and still owns it when the vessel is "re-imported". But this is only from memory.

Catabroker is right, EU VAT only needs to be paid once but you must carry proof like an invoice or VAT-paid statement.

Unfortunately that is not correct, I can't find the actual paragraph/publication number in EU law right now, but start looking Noonsite: EU boats to pay VAT again after 3 year absence here for details. If the boat is gone from the EU zone for more than 3 years then VAT needs to be repaid upon re-entry.

the website that is mentioned is not an official EU site, this is sort of 'hearsay'.
I will check to see if I can find some official legislation, but I am 99.9% sure about my previous statement.
