Sign the petition to prosecute the Lake County Sheriff that killed the sailor

I don't know if the sailing community remembers this miscarriage of justice on Clear Lake, California, when the Sheriff, under the influence, ran his powerboat at high speed at night over a sailboat, killing one, injury to others. Due to his position, he arrested the operator of the sail boat and charged him with the death.

Because of his position (past position they finally canned him) it has and still is a travesty of justice. He needs to be held accountable for the loss of life. Not much can be done for the poor guy on the sailboat's tiller. He lost his job, all of his savings and his home, defending himself.

Thanks Captain Jeffry. With yours and others help on the petition, justice might finally be served to a law enforcement officer that felt his position put him above the law. I remember when this happened (I'm 2 hours from Clear Lake) and am surprised it has taken this long just to get a petition to address this miscarriage.

Defendant Perdock Motion to Dismiss rejected.

Document 80 :: Dinius v. Perdock et al :: 3:2010cv03498 :: California Northern District Court :: US Federal District Courts Cases :: Justia

This means the criminal suit initiated by Dinius (he was at the helm of the sailboat) is moving forward. District Attorney of Lake County is denied prosecutorial immunity.

Thank goodness this hasn't dissapeared! Have seen this so many times with the misuse from positions of power through the years.

Keep in mind the state is under severe budget cuts. The wheels of justice grind slowly, in the current condition they work even more slowly. I am trying to finish some civil legal matters in the state and I am into month 22 of what, by state law, should be a maximum of 12 calendar months.

The hours of the courts have been curtailed, staffing has been shrunk. I better shut up at this point.

Thanks. It took me 1/2 hour of reading to know what was accepted and denied. On a side note, I've been interested in buying rental property at Clear Lake but have found out so many of the residents are retired LEO and it is a real "good old boys" community.

Being from San Luis Obispo county, having family and friends in Lake, Colusa, Napa, Plumas, Placer, Merced, Fresno, and San Diego counties, you don't even want to hear the many stories of abuse of office coming out of the various Sherf dept. Good ole boy only begins to describe. Of course, being one of 'em is a good thing. It wasn't a bad thing when the population was far less than it is now.
