EU/Netherlands title vs registration

Hi i'm looking at a private sale boat registered and flgged in the Netherlands. They have the certificate of registration, but do not know of a "title"

I'm trying to figure out; do all boats in the EU or specifically netherlands have proof of ownership via a title or do they have something else?

Any help would be MUCH appreciated!

Proof of ownership is usually his bill of sale, in his and the previous owners name, which you should receive and hold on to as part of your ships papers... some of the more formal forms of registration such as the Lloyds Part 1 list how many shares are held and by whom but the majority I believe do not.. merely the name of the person the boat is registered to.. the SSR is an example..

By far most boats in the Netherlands have no title or other registration. Most common as proof of ownership is a signed contract of purchase. Besides that it is compulsory to have proof that VAT (BTW in Dutch) has been paid for.

Above accounts for the absolute majority of Dutch vessels. There is however a registration, which was compulsory when putting a mortgage on your boat, that is held by the Dutch Kadaster. Mortgages on recreationalboats have become rare in the Netherlands.

In most standard contracts you will find passages where the seller declares that the ship has no mortgage or registrstion.

Umi gave you the correct answer!
There was an unofficial registration for abroad sailing, accepted in the EU and elswhere called ICP, International Certificate of Pleasurecraft, which was supplied by "Watersportverbond", when you could showed your identity and a signed bill of sale.
The VAT/BTW item is very important to have!

So, in short: If one is buying a vessel currently registered in Netherlands, me as the buyer would want to receive:

- certificate of registration (and removal)
- bill of sale (with stated no mortgage/lien clause)
- copy of VAT paid


I do not need to worry about:
- tonnage certificate
- certificate from the Dutch Kadaster (how would one know there is no lien/loan?)
- title or builders certificate

That is correct, you should ask for the Kadaster form, this is an official registration, when there are doubt about the morsgage status.
Aan other item I would advise is the CE certificate , Certificate of Compliance, and manual, which is important for yachts build after 16-06-1998.

Ideally you want:
  • Builders certificate
  • Original invoice from builder/dealer to 1st owner
  • Bills of sales for each new owner
  • CE Certificate (generic for type of boat)
  • Certificate of compliance (specific to the boat's hull number)
  • Owners manual
  • Registration certificate

The original invoice is pretty key (and an issue I'm working through just now) as it demonstrates both title and tax paid. Without it you at least want proof of tax.

The builders certificate, original invoice and bills of sale give you the chain of ownership and together demonstrate title. To register on the UK Part 1 you need to be able to show title for at least 5 years.

If the registration is on the Kadaster then you can apply on their website for a copy of the extract and for information on any mortgage on the boat. The ICP is less formal - don't know if you can query it and it only requires the current owner to have provided their bill of sale.

Regarding the certificate of registry deletion, I assume I receive that at some point after the sale. How long does this normally take (weeks/months?).
