leave in US charter but with OZ registration?
 
Hi,

Does anyone know the rules and regs if we purchase a US registered vessel, as Australians, and want to leave it in its current skippered charter? How can this be done?

At the core of the problem is that as non-US citizens you cannot register a US-flagged vessel and in order to charter from the US the boat needs to be US-flagged (look up the "Jones Act").

So the question is where the boat is being chartered from?

That is also my understanding.

The work around is registration via a US corporate entity. Delaware is the US onshore "offshore" go to place - but might be better off getting incorporated in the State you operate from (florida?).

I would heartily suggest you get professional advice (including on the tax) before deciding the approach to be used, to avoid shooting self in the foot! Unlikely to be rocket science (nor wildly expensive), just need someone who actually knows all the rules (and has PI cover!).

David - the ownership of a Delaware corporation that is to own a registered vessel must be at least 51% American so that way won't work, either.

When I bought my Hunter 37 back in '04 I was told my boat was American and would always be... so could enter/stay/depart at any time for as long etc... regardless of UK reg...
I however was a completely different matter...:p

So ill check out Delaware because my brother lives in the states with his American wife so if needed they could control the corp. entity.
