Re: Skipper's Duty Towards Refugees

I just waded through 12 pages of this thread and no clearer to knowing what the common plan of action is as felt by the majority.

Maybe that is the answer. Each person will make up their mind on the day and the event. Perhaps that is the best we can do considering the fast paced ever changing world we live in with attendant security issues.

It is not an easy one.

I consider Tortoises more akin to humans than Turtles. Naturally land bound but adventurous enough to get wet from time to time.....

Bludi heck, I knew it wouldn't take long for the tortoise / turtle divde to raise it's ugly head after Carstenb's mild reminder to hold the OP's course steady...

The entire mod squad is holding its breath that the Turtle/Tortoise divide does not break out into forum wars.........

Re: Skipper's Duty Towards Refugees

If I ever encountered a situation described by the OP and had a feeling that they were in trouble........ Gut check time!

Call in the present Lat/Long of the vessel.

Type of vessel.

Approx: number of people

Present condition of vessel with sea state.

Stand off close enough to keep an eye the boat, but far enough to hopefully discourage anyone from trying to swim at me?

If the boat goes down, I think you must try help save who you can. Children first. Toss over whatever you can to at least help as many survivors stay afloat as long as possible. Keep your vessel as safe as possible in the process. You can't expect to save them all...... (most likely)

I would sleep better knowing that I did what ever I could. I don't know how anyone could motor/sail away from a situation like that.

It might be only me, but I think we've already decided the skipper's duty, hence the thread drift.

That's so cute. Do they bite?

We aren't permitted to have them here. 40 years ago when I was a bit younger we had terripins but that's as close as we had. But they were banned and now all imports if turtles or tortoises are banned.

No. You don't.

Judging by your posts, you are no attorney. That means you don't know the law any better than any other layman.

Even if you do know the law, you don't know the law beyond the horizon, as pointed out by the women from the Middle East.

Believing the things you believe leads to anger, doesn't it?

Yep, we have moved on

So just what should a turtle do if he / she comes across 50 tortoises nearing the coast in a blatantly over crowded and unseaworthly vessel with weather deteriorating.

IMO, this is a clearly a tort but what is the best course of action?

bouche ferme - well, I'm not so sure

If it wasnt for the fact you have a Westerly and spending a fortune on her, I would consider you a Turtle lover and abandon you to your fate.....

However. Welcome.

well, she was politely telling you to be quite or rudely telling you to shut ya moth.

Now, about them turtles. Sorry, tortoises! tortoises have no place on a boat. Their land luvers and that's where they should stay. Now if they are using the boat to move between lands, well that would be illegal given there is no United nations conventions on tortoises as refugees..
