Class actions cannot be instituted in the EU. In any case not on the usual USA basis. The legal battle will be in any case a very long one.
There will be also the question if the insurance is going to draw the purse. Maybe they will cover some of the ship' s body but even that is a subject for a closer study. This is not a car insurance where the terms of agreement are reasonably standard.
These documents cover tens of pages with all exclusions meticulously listed.

The calamity with the Concordia could very well finish off Costa Crusales.

How confusing, the captain may have ordered to blow the whistle, some one down the line may have pulled the whistle out of his life jacket and started blowing, that may explain. I can see Atoll coming up with another explanation.

The AIS data is embedded in this previously-linked video:

gCaptain’s John Konrad Narrates the Final Maneuvers of the Costa Concordia [VIDEO] | gCaptain - Maritime & Offshore

It claims to be from a source on Giglio. The other AIS tracks are from a source that missed the AIS updates from before the initial turn to starboard until the ship was well past Le Scole, so required heroic (and incorrect) interpolation. The rest seem to be guesses, not AIS data.

That was more or less already clear in the very beginning as it was the most close option. So nothing exiting about that. What is interesting to learn is the fact that every turn has to be calculated precisely. A ship like Concordia does not sail a railway track but wind can deviate and influence the rate of turn, help it or work against it as the height of the vessel is a windcatcher no 1.
Captn Schettino wanted to come as close as possible to the shore and erred in the process.
The aftermath is of course a career-ending story and factually the charges already pressed are clear enough.
Divers could check the rocks of Le Scole and the evidence that something heavy came along should be easily found.

This is only the beginning of a drama that will know some further stages. If Costa Cruises is accepting full responsibility or not. Everything points now to the captain and it might be interesting what the terms of insurance dictate in such cases where a captain carried out or showed irresponsible behaviour. To say it friendly.
That is what will be to be cleared right now.

Pretty sobering reading, and for the courts etc to make such a statement there must be some damming evidence against him, which we the public have not seem, i.e. the VDR data, plus witness statements from mates and engineers.

One thing I think he may have got a little bit right was the decision to hold off on sounding the General Alarm, but get the boats down to the embarkation deck before the muster (if indeed that was his decision)
I cannot imagine the scenes of chaos in trying to prepare a coupe of dozen boats with 3000+ frightened people in attendance.

Various web sites collect AIS data using shore stations to receive the AIS signals transmitted from vessels in their area. MarineTraffic.com is one of them, and if you google "vessel tracking sites" you will get a list of others.

It is important to recognize that the source of the AIS data is the ship transmitting it. gCaptain received Concordia's AIS transmissions via a receiver at Giglio. CarinaPDX is correct that various other graphics that have been posted here are not based on Concordia's AIS or GPS data.

Further, if you happen to live at a location near a water body without existing AIS shore stations, some of these vessel tracking web sites will offer to provide a receiver to you to connect to your internet service so that they can extend their coverage. Nice reconstruction but not very convincing at 0.864 nm (1600m) from Le Scole and not attempting a radical turn, all the bridge must have been watching soccer. Also no data is presented and the source of the data is unidentified.

Disclaimer, we will not know the EXACT details of what happened until the Voyage Data Recorder (VDR), aka Black Box, is analyzed.
When they identify it as "A reconstruction based on recorded AIS data" they are identifying the source as the Concordia's AIS transmissions. The plot of the position information is a presentation of that AIS data.

A lot more information will come from the Voyage Data Recorder. It will not change the AIS plot, but will add to the story. Such things as orders given, crew execution of them, compartment flooding alarms, failure of machinery and systems, Concordia's communication with CG, company, and other parties, together with the timing of such items will be known. The disclaimer really just means that before reaching conclusions as to who is at fault the whole story needs to be known.
