Pink Lady vs Pink Lady

Anyone who thinks that the Pink Lady apple company is being unreasonable needs to take a look at the two logos and realize that the one for the apple was without a doubt first. See any similarity in the text, the color of the text, the background object, the color of the background object ?

And from Jessica Watson sails into new row over boat name - Telegraph

Quote:
John Durham, Pink Lady Australia spokesman, said that the company wrote to Watson's management in October last year advising them of its registered trademarks on the Pink Lady name and heart-shaped symbol in more than 70 countries worldwide.
Quote:
"We never imagined that she would (damage the trademark), the letter was just to make her management aware."

Mr Durham said that Pink Lady Australia would talk to Miss Watson's team about the potential for striking a deal.
Quote:
"We've never discussed that with them, they may or may not have any interest in discussing it with us.

"But Jessica fits the profile of the target audience we have, particularly in Europe for Pink Lady apples."
To which Andrew Fraser responded ...

Quote:
Andrew Fraser, Miss Watson's manager, said he would assess commercial and sponsorship endorsements on their merits but was wary of business interests trying to cash in on her homecoming's publicity.
You have to admire his lack of appreciation for the utter hypocrisy.

These people are ruthless. The last person to infringe the apple company's trademark was forced into child labor:

If Team Jessica's PR people have legal counsel with any experience, they'll play ball with the Pink Lady Apple people. If it were one of Disney's trademarks they had infringed, they might just as well sign over their first-born - Disney takes no prisoners and they don't care how tiny the pipsqueak is who exploited their trademark. They'll tighten the screws until it hurts, then tighten some more.

I'm guessing the Pink Lady Apple folks have a pretty good idea how to do that.

Tao,

I agree with you. I think that the Pink Lady apple folks have played exactly like we would want a corporation to play, honorably and reasonably rather than out for every last drop of blood.

Sarafina,

Agree with you too. They are my favorite lunch apples and we eat quite a lot of them.

And smart enough to wait until the "prize" is almost certainly proven to worthwhile (successful) rather than take a gamble earlier on when the mission was still in doubt

As I've been saying for some time now, it's really really really really really bad karma to paint a boat pink.

And don't even get me started on painting apples.

Different shape, font and product. An infringement claim would not have a chance. Regards, Richard.

Re when Gary Kinder invested, found and recovered the treasure from the deep water wreck [SS Central America] The 'lawyers' were waiting at the dock in Florida when the ship arrived with the hard won treasure [the wreck sank in the 1852!] And while the judge did acknowledge that the attorney's clients did have a 'legal' claim due to insurance that had been paid on losses, he said the interest they sought had been eaten up by the effort in finding and recovering the treasure!
So Jessica, how much will you charge the Pink Lady apple people for the tremendous advertising effort they have realized. I never heard of them before this! Pink Ladies is a pretty inoccuous and world wide 'name'! My kids drank em.
