Is this like Hazzard county?
Maybe Boss Hogg needed to raise some money so he sends Rosco out to stop the good ole boys, bust a tail light and issue a fine.

Hmm, now I'm wondering if the house was rented out. That might make a difference in the ability of the owner to claim the house as the legal residence.

Now,now, Anjou--be nice

Just up the road from you, (City Centre, and Handsworth), you had some interesting police activities a week or three back.

(Will be there on the 14th)

Tori, Lake monroe has some very nice cruising areas.

Common sense answers that easily, if you are not physically living there or off on a short term vacation it is not your "residence." It may be your property but it is not your "residence."
- - Key here is the term "vacation." Short term absence with intent to resume "residing" there upon your return maintains your residence status even if somebody else is "house-sitting" the place. Permanently moving to a "static" living situation somewhere else means you no longer "reside" at the former location even though you may still own it.
- - It just doesn't pay in the long run to try to "game/push" the system. You may get away with it for a period of time, but sooner or later something will happen and all of a sudden a whole pile of problems dump on you.
- - Government entities at all levels want to know who you are and where you are and trying to fight them individually is a loosing battle. Look at your new drivers license or State ID - you will see that starting last year there is a RFID chip imbedded in it - Federal requirement so that LEO's and anybody else with a "wand" can know everything about you instantly on the spot. Welcome to the brave new world. . .

You just cannot have mail to pile up on your house's front porch for months or a year or more.
Mailing address and residence address are different. The Federal Real ID Act requires that the drivers license state the residence address, not the mailing address. You could have all your mail forwarded to a friend or relative, or a commercial service, but you cannot use that as your address for drivers license, at least in Real ID states (Fl is one of them, I believe). This also applies to your voter registration.

The laws may be clear to you, but to me they are anything but clear cut. It seems that one of the factors in determining the permanent residence address is "intent to return". Voter registration could be used as evidence of such intent, or maybe a drivers license (a circular argument!), or a legal affidavit?

I agree, but the first step is to figure out the rules, and they are not obvious, at least to me.

Re: Joe Was Arrested

For several years, as a liveaboard in the SF bay of California I had a PO box number as my address on my drivers license.
Once again, it depends.

Re: Joe Was Arrested

IME all Govts / Depts get confused about folk who genuinely don't live in a single place and that all documents don't match addresses.

From my (vague) understanding it appears that the "PoPo" do have OP's hubby by the short & curlies on a couple of points (i.e. the tags were not current).....I would certainly be throwing a lawyer at this (and if it helps maybe also get his written opinion that you do in fact live where the vehicle is reqistered - you just spend a lot of time on your 30 foot sailboat, hence you have some mail / contact details via the Marina - and you telling the officer where you are based at the moment).....in any event maybe he can cut a deal where the Security Clearance is kept - in exchange for s#cking up a couple of charges?

I think it makes you ineligible for a Florida driver's license.

Exactly--in the Third Reich the government went so far as create Gypsy camps (Zigeunerlager) for the nomadic Roma peoples living within Germany while trying to figure out how these people with no permanent residences fit into the scheme of things. Later they were simply sent to Sachsenhausen and similar concentration camps.

Once again the laws are not clear cut and some statutes are vague and open to interpretation. Nobody was trying to push an issue or be untruthful we simply have two addresses at the moment. If a normal person with no criminal history breaks some vague law they should be warned and not arrested. Arrest is for criminal activities like theft, rape, assault, murder etc. Not for a very recently expired tag or confusion about an address. We were targeted due the Joes occupation and the appearance of our vehicle and when the officer could not get the felony arrest he so clearly wanted he searched his computer in his car and found something to arrest Joe for. Sad but true maybe this is a "police" state but a trip to jail is humiliating, stressful and absolutely unnecessary.
