Re: Two Questions: One Regading the Deposit, One on who Owns Survey Report

You could employ a buyers broker one who is working to ensure your protected though you may need to pay them a fee out of your own pocket. It could be worth the piece of mind.

Shouldn't have to pay them anything, buyers broker splits the 10%, of course the sellers broker doesn't want you to have a buyers broker, that way they keep the full 10%.
Is this boat brokered?

There is a hint here. I don't know if it was the same boat.

Re: Two Questions: One Regading the Deposit, One on who Owns Survey Report

ty, I echo the sentiment of the others here. One of the many hats I wear is marine surveyor. Survey is the property of whom ever orders and pays for it, you can disseminate as you wish. If I were paying for a survey on a prospective boat, no one else would see it let alone put their hands on it, unless as stated before there were issues I wanted addressed before purchase. Or you could use them as a negotiation point on price prior to purchase and then have the issues addressed post purchase by a professional that you would want to work for you. Never ever let someone else copy your survey. Having said that, when I am considering a purchase on a vessel, I am not shy about asking if they have a current survey I could see, if one is available, I have never had that request turned down. If it were turned down, I would not be offended, it can't hurt to ask. Always have a 3rd party hold the money "escrow" . Always have a mechanical survey done by a competent engineer/mechanic, I prefer an engineer because they are marine based and likely know the little trouble spots. Always have an oil analysis performed before committing to a purchase. CYA once they get the money, you will have a hard time, getting redress.

Well, that's good to hear, Ty! Could you fill us in on how you dealt with the contract issues that lead to your initial posts? It sure sounded wonky at the time!

Thanks,

Jim

Congrats TY! How did the sale go? Did you redo the contract? Did you get a buyers broker? How'd the survey turn out? As someone looking at boats and planning to buy in the next year all advice and learning is welcome.
Thanks,
Caroline

Is this boat brokered?
This concept always makes me cringe a little... If the are being paid by the seller, who do you think they really represent?

Andy and Pilot have it right! Two brokers split the commission, you paid for the survey and own it unless you have a contractual arrangement to share which I'm not certain is legal to require. Phil
