Tax law in Italy - export

I have recived lot of many interesting informations that I thanks for all of you, but I am still looking for some answears and hope some of you can help me with that.

so as a representative of Cyprus company I have bought a motorboat in Italy and I have registered her on Cyprus-bandera. She is 50 feet long. I received a net invoice (no VAT / Vies) and paid net price. As I mentioned before I have found a buyer for a boat for export ( looks like we would make deal at US waters) . At the end of year at the Genoa boat will be loaded on the ship to St Thomas, US Virgin Islands. What should I do that the Italian customs office did not want me to pay VAT/Vies of this boat? What should I prepare, what documents, informations etc. I plan to cruise a few months over the Caribbean and then she would be sold in that area or in the USA.

Hi,
Was the previous owner of the boat an Italian company or an individual person?
If it was an Italian company, did it pay the Italian VAT (IVA) at some time?

use a customs agent,the bill of sale and Cyprus registration should satisfy the customs as long as the boat has been less than 18 months in EU waters,and you are not an eu resident


the boat will need a customs clearance and bill of lading before it is loaded on the ship,the customs agent will also need original documents,not photo copies for the clearance certificate

Previous owner was Italian Company and they paid VAT throught to paying a Leasing rates and they bought it from a leasing company paying Net price and VAT.

Boat has been much longer than 18 months in EU and I am a EU resident as well.

Did you have this kind of experience with Italian regulations?

do you have proof that the previous owners paid vat on the vesselt,the customs may ask you to pay vat if you cannot prove that vat was paid at some time in the boats time in the EU.

and yes I had a similar experience in palma and Cyprus regarding unpaid vat .

in Cyprus we elected to pay the vat,as the boat was staying in the EU.

and in palma we sailed to Algeria to reset the temporary import permit before shipping the boat to Singapore from palma,as it had overstayed its previous 18 month grace period,and would have been liable by default.

Hi,
you can ask the tax authority in Italy (via a customs agent) to issue you the T2L form. It is an official form that states that VAT has been already paid on your boat in a EU state.
See T2L Document - Cargotransport.org
It is normally used to proof paid VAT when dealing with a permanent intra-EU transfer. However, since you are exporting the boat to a non-EU country, VAT status should be irrelevant.

I have an invoices which are paid. I have checked formal status of yacht with a italian lawyer and got all documentation that there was no debt or other inconvenient. I am also in touch with a Port Agency Manager about all neccesery documentation for shipping. Moreover he has informed me that if a yacht is under Cyprus flag any VAT issues if so should consider Cyprus customs no Italian.

So I have recived some info about T2L and

"Please note that t2l document can be issued only when EU good is transferred between eu ports and this is not the case."

Also abou 18 months period I have recived info that it is not in my case as well.
