... the flag under which you sail has nothing to do with the nationality of the owner (or crew). It is all about the nationality of the VESSEL'S REGISTRATION. If, for instance, your boat is registered in Panama as a Spanish citizen, it flies the Panamanian flag off the stern. Or, just to be very correct, an Aussie with a Luxembourg registered yacht will fly a Luxembourg maritime flag (different from the national flag). For Brit and Aussie registered vessels this means their respective red ensigns - not the regular national flags which is the case for most nationally registered yachts. State registered yachts should fly the national maritime flag or the national flag whichever is legally correct as mentioned above.

And the correct size of flag is 1" per foot of the vessel LOA.

A listed ship under 12 m I believe has the choice in Australia of flying the Red or the Blue.

Personally I'd fly the red simply because I'm permitted to and listed ships are the only ones allowed to (But I don't have either just yet)

I also intend to fly the Indigenous flag on special occasions but always with the red.

What I was pointing out was correct flag etiquette. Most people couldn't give a hoot or (worse, in my opinion) simply can't be bothered even if they do know the etiqette.

And just to stir the pot a little further... it's discriminatory on more than just size. The skin colour (of the flag) is a serious factor. So it's racist too!

I take it your vessel is Australian Owned within the meaning of the Shipping Registration Act 1981. (Commonwealth Law) - If so you commit an offence under Section 69 if you leave a foreign port (in most cases) - not that anyone is going to care while you stay out of Australia, but be aware of this if you ever intend to return.

Last time I checked what mattered was not the nationality of shareholders but the nationality of directors/officers. I was told I (not US citizen) could own a corp that could register the boat with USCG if my American daughter was the only officer of the corporation.

Those non-Americans who think about state or USCG papers in the US should figure out how would they handle estate tax on US-situs assets, for which there are significant breaks only for those with US citizenship or domicile.

Re: Flag: USA or AUS?

Oh my.
Delaware does not care about your citizenship. That is only a factor for Federal documentation, not state registration.
I think if you have a problem off shore, the nearest coast guard will help you regardless of your flag.
Keeping it registered in Delaware is the easiest and cheapest.
Why spend money frivolously? Now, if you were telling me you like the looks of the Guernsey flag, well that is okay. Splurge.
I myself never fly Old Glory.I fly the US Navy Ensign with the snake on it. And have tea parties of course.
(American inside joke)

Why can't things remain where i carelessly left them?

Never mind, ya been here long enough to honorary ockers

And you even know a good number of aussie colloquialisms it seems; especially Ann

Heck you know more about east coast Oz cruising than most of us here - although I might pip you when north of Cooktown

Another tangent, we went with Jersey (UK) because it only took a week for the paperwork vs 3 months from what other Aussies told us. Jersey is well regarded and pretty cheap.

You might want to check with your insurer if they mind that you are committing an offence.

Re: Flag: USA or AUS?

An offence? Since when was it an offence for Australian to own foreign property?
I would query the wording of that bit of the regs.
