Boat Lemon Law

That second happiest day in a boater's existence has just happened to me. I have sold my boat. The check has cleared and the owner is coming to see the boat...for the first time. Someone bought my boat over the phone, which in and of itself is amazing.

I am wondering if there is a lemon law with boats, or if there is a given amount of time before I can start spending the boat sale money safely. The boat is in very good condition but you just never know how people are going to react.

The boat is registered in Pennsylvania, being sold in Maine, and the owner is from New York.

I thought US lemon laws applied to manufacturers, not second party transactions.

Most states have a law which gives peolpe 72 hours to rescind their decision on purcahses over a certain amount (usually $1,000). If you have signed contracts, transferred documents and funds you should be good.

When I draw up a bill of sale I always include a clause that states the sale is "As is" and language regarding limits of my personal liability relating to future use of the boat, i.e. a ""Hold harmless clause".

The 72 hour rule would only apply if he sold the boat door to door. The only rule he falls under is the automatic AS IS law that is applicable in all used vehicles, unless there is a written warranty...
