For that reason charter companies need to keep their insurance premiums as low as possible.
I think "no night movement" for charterers is a no brainer, for the multitude of reasons given above.
Also keep in mind that this is not just a USA issue. It is quite common thrughout the Carib.

While running at night is second nature to some, the average bareboater is not very experienced. Running at night safely is a skill acquired thru experience. Even with that experience, night operation does involve more potential risks such as hazards you cant see for example, unlit vessels, etc...

Morphing thread here...I had to bite my lip on simpleton comment on health care litigation in the US...but... In my experience, the fish is called a dolphin in the Gulf of Mexico, a dorado in the Atlantic and a Mahi Mahi in the Pacific.

Off course, if it was not important to you why mention it?

Off course you can find charter companies that don't allow you to sail at night but the general rule on the med is this:

"THE CHARTERER MUST NEVER:
- Run a commercial passenger transport service with the
vessel.
- Participate in any sporting competitions, unless authorized to
do so.
- Hire out the yacht.
- Tow another craft except in emergency.
- Sail at night except in good visibility and always under good
weather conditions.
"


and of course this:

SAILING CONDITIONS: By signing the charter contract the
charterer confirms that he or she displays all the required
knowledge of seamanship and navigation to sail a yacht on the
open sea. Otherwise he must appoint a captain for the vessel,
who should sign the charter contract too.
By signing the charter contract the charterer affirms that he
possesses a sailing certificate and has the required level of
seamanship skills.

The charterer will be held responsible for making any false
declarations. The charterer and vessels captain, in so far as
they are not the same person, are completely subject to the
terms of this contract.

They are pretty much the same. The above quotes are from the AYC contract. AYC is one of the biggest if not the biggest in Croatia

Sailed a charter cat out of St Martin from Saba to St Croix overnight about 5 years ago. Beautiful night sail and not exactly rocket surgery for experienced sailers. Not mentioning the company just to avoid any hassles for them. Ask the smaller companies, everything is negotiable.
