Re: New Florida Anchoring Amendment!

Having lived in Florida for a decade, as a resident alien (A.K.A. Green card holder) and working closely with a City Hall in a major city for a period..... I can tell you from my experience, that your desires as residents are low on the list. I have never met so many self serving people in all my life. What my eyes have seen......

That aside, if the powers that be want something or owe somebody...the only way they will relinquish it is if it affects them politically or personally right now.

It is always a source of annoyance that the "representatives of the people " keep bringing up stupid ass schemes on a regular basis. This is not a go at the good ole USA....... Britain taught them how to do it and right now Britain is continuing the tradition in the U.K.

EVERYONE nationally should vote in EVERY State for something that will eventually affect them by the trickle down method. Dont think that the governments local or Federal are playing by the rules........ Dont even think for one second that the 'people' have much say..........political change of heart comes from threat of repercussion that affects them personally.

All you have to do is play by the rules that you think are set in the Constitution, and you will see it crumple around you. The Republic of America is being subverted daily and it pisses me off. It also pisses me off that boating is being squeezed into a rich mans playground.

rant over.

As you were.

What is the correct way to text applause? 1 post slipped in before the one I'm applauding. Not that you don't deserve applause too.

Anybody from Jersey care to pipe in?
So you want to travel for free, but have a happy clean backyard?
What about your desire to travel free when you go to Miami. That ass**** wants a tidy backyard off his mansion. see the issue I believe a perfect example of hypocrisy in action.

As an FYI it's quite possible to travel toll free from the Delaware river to the Hudson along the non toll roadways in NJ. Just like it should be free to anchor outside mooring fields.

thanks for that example.

From "Cornell University Law School - Legal Information Institute"
Some pertinent sections of 33 CFR Part 329 - DEFINITION OF NAVIGABLE WATERS OF THE UNITED STATES

An interesting analysis of the federal, state, and local government law that surrounds the practice of anchoring on the navigable waters of the state of Florida. (With case-law citations and footnotes)
While I do have personal opinions about the issue in the OP, they are not germane to the arguments quoted above.

Now please excuse me while I make some more popcorn...
This is an interesting enough quote from that source (sorry about the formatting):

The authority of local governments to regulate anchoring and mooring within
legally marked mooring fields, however, is not in doubt. Under Chapter 327,
local governments can exert control over any and all vessels anchoring inside a
designated mooring field within their jurisdiction. Perhaps the best hope for local
governments seeking to regulate anchoring outside of designated mooring fields
will crystallize with the new pilot program created by Section 327.4105. Administered
by the FWC and still in the planning stage, the successful implementation
of this pilot program could provide a way forward in the ongoing policy debate
over how much authority local governments could or should have over the activities
of vessels navigating – and anchoring – in the waters under their political
jurisdiction.

When I was in St Augustine I got my haircut in this little barbershop. The barber told me that a large percentage of her customers were cruisers. but since the mooring balls were put in that virtually stopped, and after 20 years being in business she's probably going to have to close down.

The Margolis amendment to SB 1126 failed.
The bill SB1126 passed!

You are conceding, then, that there is no section of the national constitution regarding navigable waters?

And that, therefore, the claim that national rights regarding navigable waters being enumerated in the national constitution is false?

(Is that popcorn ready?)

Re: New Florida Anchoring Amendment!

Jammer Six

Your argument seems to be that under your constitution, the residents of a local county are the only people with a valid say in how "their" waterways are used.

If I have got that correct, what stops your argument being equally valid to support them choosing to fish with dynamite?

If that's OK, how about with cyanide?

OK? Radioactive waste, then?

Pretty sure there's nothing in the constitution trampling on those particular "rights".

Didn't think it was complex; those that didn't win the war were the losers.
