Although I'm not an attorney one of the things they teach you in business law is that we have the concept of strict liability here in the U.S. so a person can never sign away their ability to sue for liability. The one and only purpose for all those thousands of release forms we've all signed over our lifetime is to make us think we have signed away our rights and thus not contact an attorney. So I'll third the advice to contact an attorney!

The first comment which is correct. Why internet jockeys like to give legal advice is bafflingly. And not helpful.

Please don't denegrate boatpoker or categorize him as an "internet jockey". He is a seasoned marine surveyor, who was not only trying to be helpful, but also deals with insurance companies all the time.

So he DEFinitely knows whereof he speaks!

WalMart dropped my brothers truck off their hoist and wouldn't take responsibility (can you imagine that?) so he sued walmart and won, but then got a lifetime ban from all walmart stores LOL

Having worked in the field for ten years, personally seeing three vehicles fall off or driven off a lift it blows my mind ANY company would try to deny liability for it.

The places I worked immediately assumed responsibility.
