Jamestown Distributors - Stay Away

I ordered four cans of bottom paint a couple weeks ago from Jamestown Distributors and when they arrived two were dented and leaking, and the other two the UPS guy didn't leave because they were obviously in worse shape. Paint is now all up and down my driveway and over the patio.

These cans were just cans in a cardboard box - no packing material of any kind. Jamestown customer service (Matt McClusky) blamed it on UPS and said Jamestown has no responsibility to rectify this. That's not right - paint all over my driveway and damaged/leaking cans. Clearly this was improper packing at fault here.

The paint is solvent based hard bottom paint (Petit). It sticks like crazy. To fix this will require abrasives and resealing of the driveway. My contractor quoted $2,200.

Jamestown Distributors sucks. These guys are losers. Stay away.

I have purchased stuff from them with no problems.
I have had problems with UPS, but imho Fedex is worse.

Document it. Assuming you paid for shipping, the vendor is responsible for safe delivery as they subcontracted the job out to UPS. Send them the bills and don’t let up.

Your order may have been shipped "FOB Jamestown - Freight Prepaid". In this case Jamestown has no liability, which rests with UPS.

In North America, "FOB origin" means the transfer of ownership & liability occurs as soon as the goods are safely on board the transport. "FOB origin" (also sometimes phrased as "FOB shipping" or "FOB shipping point") indicates that the sale is considered complete at the seller's shipping dock, and thus the buyer of the goods is responsible for freight costs and liability during transport.
"FOB destination" means the transfer occurs the moment the goods are removed from the transport at the destination. With "FOB destination", the sale is complete at the buyer's doorstep and the seller is responsible for freight costs and liability during transport.

I have had nothing but excellent experiences with Jamestown. I have done a lot of business with them.

I have had many problems with UPS. Since they don't require signatures anymore unless stated, they have gotten worse. They delivered a package to the incorrect address, then lied that it was delivered and signed for correctly. We were out $5000 as the equip wasn't insured. Lost packages, damaged packages, the list goes on.

I can't say I have had problems with Jamestown, but I will say that my last order from Defender which contained 4 gallons of Brightsides and Bilgekote arrived with 3 of the 4 cans severely dented. The packing boxes were in perfect shape, but the cans looked like they had arrived from a war zone.

That really sucks about our delivery, I would pursue whomever packaged the items for recompense.

Positive experiences with both Jamestown and Defender - places I go for better prices after checking with the big guy. That includes shipping paint. I doubt the cans leaked when they were packed, and who beats up a can, even if it's just in a single box? It should have the little black shipping clips around the rim.

Jamestown Distributors didn't get paint in your driveway. Why would they be responsible for that?

Your beef is with the shipper.

I can say that I've ordered solvents online that showed up dented, but not leaking.

Mail order is cheaper, but maybe not optimal sometimes.

Although I stay away from Jamestown because their prices are so bad, this is the fault of the shipper. That’s who spilled the paint in the driveway.

Like Gord said, it's who paid the shipper that has recourse, they have the contract for delivery. If you paid the shipping charges to Jamestown and they contracted the shipper, you need to deal with Jamestown. If you paid for the shipping directly, you need to deal with the shipper.

Small claims court is where I think you're headed, even if just to 'get their attention'.

I've had nothing but good experiences with Jamestown, but dented cans is a huge problem with careless shippers. The problem for me is, once the can is dented, it usually never seals properly again - and then develops a skin on the liquid's surface and all kinds of storage problems. I'd go after the shipper - as I'm sure Jamestown did not ship out dented cans - the shipper is responsible for safe transport. Do not accept dented cans when received, and if they leave them without contacting you - call the shipper immediately and state you will not accept them. Come get them.
