In my 72 years of mostly being around boats, living aboard for half my life, and a career as a boat builder, I've never known anyone to do this unless the boat was to be unattended for an extended period.

Technically, yes, you could sue them.


Winning is another matter.


Unless it was something incredibly obvious, there is no way it could have gotten worse in the last 18months, the rebuild is incredibly expensive and you are just a glutton for punishment...chalk it up to a mistake on your part and move on.


If you really feel you must do something, ask a lawyer if he will take it on contingency.

I don't make it a habit to close the valve either. But I do go out of my way to make sure the vented loop is high enough to disallow flooding the engine by sitting.

Ah yes, the vented loop on the raw water line. Check the vented loop yearly. Take the cap off and make sure it's clean and working, otherwise it's a matter of time before it'll jam closed and let the raw water siphon into the engine exhaust as I described, like what happened to GeneM.

Thanks all! This is to close this post. I didn't pursue a legal remedy and put it in my learning curve box. I'm sure Cummins would say their risers were installed wrong. They angled up so a slug of water would slide back after the engine shut down. The riser was above the waterline, so no need for the suction break or lift muffler.

It was just an insidious intermittent degrading condition . Oh well.

For you, perhaps but not for everyone. Probably not for most people.
