Like almost anything in life, you can make the question of piracy as simple or as complex as time and beer allows, but I see this as fairly simple. Arm the ships & kill all attackers. As John Galt said, they get the only destruction they have a right to choose - their own.

The Kenyan government has issued a six-month notice to end European Union and UN agreements, saying it will not accept any more seized Somali pirates to be tried in its courts.

The country's Attorney General Amos Wako told journalists the agreements require member states to prosecute suspected pirates captured within their waters' jurisdictions.

“Everybody underestimated the number of pirates that we were going to prosecute. We all thought that it would be one or two or three maximum 10 or so. But the problem became far much bigger than we thought," he said.

"Our assumption also that other member countries would also take up their responsibilities again have not been borne out."

The country's chief legal adviser said the international community had not lived up to its promises to help Kenya with the burden of prosecuting and imprisoning pirates.

It does seem that at least some Navies / Politicos have read this thread

FWIW no such thing as "International Law", at least not in the same sense as domestic regimes have the rule of law - largely agreements between Nations enforced via a pecking order based on economic strength / gunpower.

Therefore on the high seas the Navies can hang Pirates. or simply shoot them out of the water. It's not "illegal" in the sense that anyone has jurisdiction - the only comeback is if another nation state claims them. gets offended. and can do something about it. Kinda like extra judicial kidnap and dropping folks out of aeroplanes enroute to (or from) Islands in the Indian Ocean.........no names. no politics ........no one cares what you do if you have enough guns. and a demonstrated willingness to use them.

It's not really accurate to say there's no such thing as international law. International law governs the actions of nations howerver not individuals. United Nations: International Law

Old adage: we get the government we deserve. Personally I consider it an insult. On the other hand when the government is filled with idiots it saves time reading. I just presume that whatever they said didn't make sense and count on them to line their own pockets. Cynical? Me? well, maybe but it seems to work more times then not.

There is a body of international law, most of which I am ignorant of, but piracy has gone on for thousands of years. On the high seas, there is no national law, and if some one is committing an act of piracy, they do so at the risk of their life.

Clearly, the actual pirates are at the bottom of the food chain. They are still doing the crimes, so they take the personal risk. The beneficiaries, namely the higher-ups, also need to feel the heat, in the same way that the higher-ups in the Talaban look up before they go outside.

Here in the UK, the govt is expected to resign and call an election this morning with the most detested Prime Minister in living memory (possibly in our history) fighting for another 5 years.

NPR Interview with Richard Phillips who was captain of the Maersk when pirates took over the ship in April 2009. Navy Seals shot and killed 3 of his captives on the lifeboat he was being held:
